Building Regulations Guide - (2026 update)

If you’re planning a building project in Birmingham—whether it’s an extension, loft conversion, or new build—understanding Building Regulations and Building Control is essential.

Recent changes across the UK, including the Building Safety Act 2022, have significantly increased responsibilities for homeowners, builders, and designers. This guide explains everything in simple terms, with a focus on how it applies locally in Birmingham and the West Midlands.

What Are Building Regulations?

Building Regulations are UK legal standards that ensure buildings are:

  • Safe and structurally sound
  • Energy efficient
  • Accessible
  • Protected against fire
  • Healthy to live and work in

They apply to most construction work, including:

  • Home extensions (rear, side, and double-storey)
  • Loft and garage conversions
  • New builds and outbuildings
  • Structural alterations (e.g. removing walls)
  • Drainage, electrics, heating, and windows

What Is Building Control?

Building Control ensures your project complies with regulations.

In Birmingham, you have two options:

  1. Birmingham City Council Building Control – (now provided by Acivico (Building Consultancy) Ltd.)
  • Local authority service
  • Enforces compliance with legal powers
  • Strong local knowledge (e.g. common ground conditions, drainage issues, urban constraints)
  1. Private Building Control Approvers
  • Independent companies appointed by you
  • Typically more flexible and service-led
  • Cannot enforce regulations directly (must refer issues to the council)

The Building Control Process (Step-by-Step)

  1. Prepare Building Regulations Drawings – Your architect or designer creates technical drawings covering structure, insulation, drainage, etc. We undertake this in Step 3 of our services or as a standalone package.
  1. Submit for Approval – Plans are submitted to Building Control for checking (Full Plans application). You may receive feedback or required amendments.
  1. Notify Start of Work – Your builder notifies Building Control before work begins.
  1. Site Inspections – Inspectors visit at key stages (e.g. foundations, structure, insulation).
  1. Completion Certificate – Issued once work is compliant—this is essential for insurance and future sales.

When Do You Need Building Control?

You’ll usually need approval for:

  • Extensions and structural alterations
  • Loft conversions or roof changes (e.g. dormers)
  • Garage conversions
  • New drainage connections
  • Installing heating systems or solar panels
  • Replacing windows (if not using FENSA-approved installers)
  • Changing a building’s use (e.g. commercial to residential)

When You May NOT Need It

When You May NOT Need It

Some smaller projects may be exempt:

  • Detached outbuildings under 30m²
  • At least 1 metre from boundaries
  • No sleeping accommodation
  • Built mainly from non-combustible materials

Note: Adding heating or electrics may still trigger approval requirements.

Key Building Regulation Areas

  1. Your project must comply with specific technical standards, including:
    • Part A: Structure
    • Part B: Fire safety (critical in urban areas like Birmingham)
    • Part F: Ventilation
    • Part L: Energy efficiency (tightened significantly)
    • Part M: Accessibility
    • Part O: Overheating (important for new builds)
    • Part S: EV charging infrastructure

Recent Changes You Need to Know

Major updates affecting Birmingham projects include:

    Building Safety Act 2022

    • Introduces stricter accountability
    • Requires a clear “duty holder” structure
    • Increases documentation requirements (the “golden thread”)

    Energy Efficiency (Part L Updates)

    • Higher insulation standards
    • Increased focus on low-carbon heating
    • Greater build costs but improved long-term efficiency

    Fire Safety Reforms

    • Stricter rules—especially relevant for extensions near boundaries or multi-storey homes

Duty Holder Responsibilities (Important!)

Under new legislation:

  • A Principal Designer must ensure compliance during the design phase which later transfers to the homeowner or Builder during construction.
  • A Principal Contractor / Builder is responsible during construction
  • Someone must sign off compliance for Building Control

In Birmingham, many projects can be delayed because:

  • Builders refuse to take on this responsibility
  • Or documentation is incomplete

Without proper sign-off, you cannot obtain a completion certificate.

Birmingham-Specific Considerations

Local factors that often affect projects include:

  • Older housing stock – many Victorian terraces require structural upgrades
  • Shared drainage systems – build-over agreements may be needed with Severn Trent Water
  • Urban density – stricter fire safety and boundary requirements
  • Planning constraints in conservation areas (e.g. Moseley, Harborne, Jewellery Quarter)

Key Advice for Birmingham Homeowners

✅ Always use detailed Building Regulations drawings

✅ Appoint competent professionals early

✅ Clarify who is acting as Principal Designer & Contractor

✅ Check drainage and utilities before starting

✅ Keep clear records throughout the build
